MiCA and the EU

MiCA — Markets in Crypto-Assets — is the European Union's comprehensive crypto framework, phased in from 2024 onward. It harmonizes licensing for crypto service providers across member states, sets disclosure rules for token issuers, and imposes strict requirements on stablecoins used in the EU. Passporting allows a single authorization to serve the bloc.

Large non-euro stablecoins face usage caps for payments in the EU. Issuers of significant ARTs and EMTs face enhanced scrutiny from the European Banking Authority. Marketing to EU retail without compliance carries enforcement risk even if the team is offshore.

MiCA does not cover pure DeFi with no intermediary, NFTs as unique collectibles, or securities already under MiFID — though boundaries blur in practice. Firms serving EU users should track national transposition and EBA technical standards. This overview is educational, not a compliance checklist.
